TERMS AND CONDITIONS

7.2 Late Payment: Late payments may incur interest charges at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower. We may suspend services for accounts with overdue payments.
7.3 Disputes: If you dispute any charges, you must notify us within 30 days of the invoice date. Failure to dispute charges within this period constitutes acceptance of the charges.
7.4 Taxes: You are responsible for all applicable taxes, duties, and government fees associated with your purchase, except for taxes based on our net income.
LIABILITY AND WARRANTIES
8. DISCLAIMER OF WARRANTIES
8.1 As-Is Basis: Our website and general information are provided "as is" and "as available" without warranties of any kind, either express or implied. We disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.2 Total Liability Cap: Our total liability to you for all claims arising from or related to these terms or your use of our services shall not exceed the amount you paid us in the six months immediately preceding the claim.
9.3 Essential Purpose: The limitations in this section apply even if any limited remedy fails of its essential purpose. These limitations are fundamental elements of the agreement between us.
9.4 Applicable Law: Some jurisdictions do not allow limitation of implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
10. FORCE MAJEURE
10.1 Excused Performance: Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or fuel crises.
10.2 Notification: The party affected by force majeure shall notify the other party promptly and take reasonable steps to minimize the impact. Performance obligations are suspended during the force majeure event.
10.3 Extended Events: If a force majeure event continues for more than 60 days, either party may terminate affected agreements without liability, except for obligations that arose before the event.
LEGAL INFORMATION AND DISPUTE RESOLUTION
11. GOVERNING LAW
These Terms and Conditions are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
12. JURISDICTION
Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts located in Berlin, Germany. By using our services, you consent to personal jurisdiction in these courts and waive any objection to venue.
13. DISPUTE RESOLUTION
Before filing any legal action, you agree to attempt to resolve disputes through good-faith negotiation. If negotiations fail after 30 days, either party may pursue formal legal proceedings. Mediation or arbitration may be required under certain project agreements.
14. CLASS ACTION WAIVER
To the extent permitted by law, you agree that any disputes will be resolved on an individual basis and not as a class action, consolidated action, or representative action. You waive the right to participate in class actions against Tetiana Chyzhovych Design.
15. SEVERABILITY
If any provision of these terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. ENTIRE AGREEMENT
These Terms and Conditions, together with our Privacy Policy and any executed project agreements, constitute the entire agreement between you and Tetiana Chyzhovych Design regarding use of our services, superseding any prior agreements or understandings.
17. MODIFICATIONS
We reserve the right to modify these terms at any time. Material changes will be posted on our website with the updated effective date. Your continued use after changes constitutes acceptance. We recommend reviewing these terms periodically.
18. ASSIGNMENT
